Kawira Mwangaza’s Impeachment and the Legal and Political Precedent set
Kawira Mwangaza faces yet another political setback as the High Court upholds the Senate's decision to impeach her. Meru, her traditional political stronghold, is proving to be more hostile than expected.
Will Kawira appeal to the Court of Appeal, or will she pursue an alternative political strategy beyond her impeachment? A difficult choice, indeed. This decision presents a significant challenge, making it hard for her to stage an effective comeback—politically or legally.
The High Court’s decision to uphold her impeachment sets a key precedent in Kenyan political office, particularly for governors. Her case is now a reference point for any other governor facing political opposition or what some may perceive as political persecution.
Laws are crucial, especially when holding the office of a governor. Kawira should have listened to the people and adhered to county government rules and procedures. Following the law and making decisive choices in response to public concerns could have saved her tenure.
Moreover, let it not be argued that this decision is based on gender inequality, spare me that rhetoric! Once someone is deemed incompetent in office, no legal or political maneuvering can salvage them, regardless of gender. Competence remains the key qualification for public office!
Her impeachment, upheld under Article 181 of the Kenyan Constitution and Section 33 of the County Governments Act, underscores the importance of leadership accountability. Moving forward, elected officials must recognize that legal frameworks exist to ensure governance is both transparent and responsive to the electorate.
